1. How do I keep points off of my driving record?

For certain traffic offenses, the Secretary of State will assess points against your driving record. The Court does not assess the points and does not have any authority to remove points from your driving record.

3. How do I file a Motion to Set Aside a Default Judgment on a Civil Infraction?

You must fill out the Motion to Set Aside a Default Judgment-CIA04 form with your explanation of why you feel you should be allowed to set aside the default.  A cash bond must be posted in the amount of the ticket plus the $25.00 default fee and accompany the motion form.  If the Judge grants the motion, an informal hearing will be scheduled and you will be sent a notice within approximately two weeks.  If the Judge denies the motion, the default wills stand and the bond that you have posted will be applied to the ticket and the matter will be closed.

4. What is a waivable ticket?

The Traffic Division will enter an admission of responsibility and waive all fines and costs if the defendant shows proof that a law enforcement officer signed off on the violation before the appearance date.
